1. Definitions
GDPR: the General Data Protection Regulation (EU) 2016/679.
Personal Data: means information that relates to you and allows us to identify you, either directly or in combination with other information that we may hold.
Any other capitalised terms used in this Notice that are defined in the GDPR, shall have the meaning given to them under the GDPR.
2. What is the purpose if this notice?
This Privacy Notice (this “Notice”) explains how LUXHUB S.A. (“LUXHUB”, “we”, “us” or “our”) collects, uses, shares and otherwise processes your Personal Data when you interact with our websites, developer portal, or service desk and/or other applicable platforms, or when you apply for a job (collectively, the “LUXHUB Platforms”), as notified to you from time to time.
For your use of LUXHUB Platforms, LUXHUB acts as data controller.
By exception, when processing is carried out on behalf of an API provider, for instance, when LUXHUB interacts with a natural person representing an API consumer to enable access to consume an API provider’s API, LUXHUB acts as data processor on behalf of that API provider. If you have questions about the processing of Personal Data performed by a given API provider, please contact the relevant provider’s data protection team; contact details are available on the API provider’s website.
3. What Personal Data do we process?

Special categories of Personal Data
In specific circumstances (e.g. Personal Data provided in a CV), we may collect information that could reveal your racial or ethnic origin or conviction of criminal offences. Such information is considered to fall in the special categories of Personal Data. We only process this information in the case you have given your explicit consent, it is necessary according to legal obligations, to establish, exercise or defend legal claims or you have deliberately made it public.
By providing any “sensitive” Personal Data you understand that we may collect and use it in order to fulfil the purpose in the context of which they have been disclosed and in accordance with this Notice.
If you do not allow us to process such Personal Data, this may lead to us being unable to fulfil the purpose for which such Personal Data were supposed to be processed.
4. How and why are your Personal Data processed?
We use your Personal Data for the following purposes:
- Communication: to respond to your requests, provide information or services and handle complaints;
- Marketing and relationship management: to keep you informed about our services, events and company updates;
- Analytics and Improvement: to operate, maintain and improve LUXHUB Platforms and social media pages, in particular by generating statistics regarding their use, and to personalize your experience;
- Security: to protect LUXHUB Platforms;
- Dispute Resolution: to establish, exercise or defend legal claims;
- Recruitment: to manage your job application and assess your eligibility to work with us.
We only process your Personal Data were permitted by law and for the purposes described above. Depending on the context, we rely on one or more of the following legal bases:
- Consent: where you give your consent, for example, when you register for a webinar, subscribe to marketing communications or agrees to LUXHUB’s use of tracking pixels for ;
- Legitimate Interests: where processing is necessary for our legitimate interests, such as for operating and improving our services, ensuring LUXHUB Platforms security, managing business relationships, and conducting analytics;
- Legal Obligations: where processing is necessary to comply with applicable laws and regulatory requirements, such as to verify your right to work; or
- Contractual Necessity: where processing is necessary for the performance of a contract with you, or to take steps at your request prior to entering into a contract, including in the context of recruitment.
Where we rely on your consent to process Personal Data, you have the right to withdraw your consent at any time. If you have agreed to receive marketing communications, you may always opt out later by clicking the unsubscribe link in the email you receive.
When we process Personal Data on our legitimate interests, we have conducted a balancing test to ensure that these interests do not override your rights. You may request more information about this balancing test by contacting us at dataprotection@luxhub.com.
5. How do we store your Personal Data?
Your Personal Data is stored within the European Union. We retain it only for as long as necessary for the purposes for which it was collected or to comply with legal obligations, after which it is securely deleted or anonymised. In any case, Personal Data will not be retained for more than 10 years from the date of collection.
6. Security of your Personal Data
We are committed to taking appropriate technical and organisational measures to protect your Personal Data against unauthorised or unlawful processing and against accidental loss, destruction or damage.
7. Sharing your Personal Data
Please note that we may disclose Personal Data if we are required by law to do so or if we reasonably believe that the disclosure is necessary to protect our rights and/or to comply with judicial or regulatory proceedings, a court order or other legal process.
We also share your Personal Data with trusted third-party services for purposes such as customer relationship management, webinars, newsletters, website analytics, security and hosting. These providers act as data processors on our behalf and process Personal Data in accordance with our instructions and applicable data protection law, including the GDPR. All Personal Data is stored within the European Union.
The categories of recipients include:
- Analytics service providers: companies that help us analyze website traffic and improve user experience;
- Security service providers: companies that help protect our website and systems;
- CRM and marketing service providers: companies that help manage customer relationships, send newsletters, and operate careers or contact forms;
- Other service providers and business partners: companies that provide technical, administrative, or operational support, including website hosting and IT support.
8. Your rights in relation to your Personal Data
You have rights as an individual which you can exercise under certain circumstances in relation to your Personal Data that we hold. These rights are to:
- request access to your Personal Data and request certain information in relation to its processing; request rectification of your Personal Data;
- request the erasure of your Personal Data;
- request the restriction of processing of your Personal Data;
- request the portability of your Personal Data;
- object to the processing of your Personal Data.

You also have the right to lodge a complaint at any time with the National Commission for Data Protection (“CNPD”), the Luxembourg supervisory authority for data protection issues, or, as the case may be, any other competent supervisory authority of an EU member state.
9. Cookies
We use cookies and similar technologies, including tracking pixels in emails where applicable, to operate our website, improve your experience, analyse website usage, and measure the effectiveness of our communications.

10. Fees
You will in general not have to pay a fee to exercise any of your individual rights mentioned in this Notice. However, we may charge a reasonable fee if your request to exercise your individual rights is manifestly unfounded or excessive. Alternatively, we may refuse to comply with the request in such circumstances.
